M & G Sues Red Bull/Alpa Werke For Patent Infringement

Cobarr, a company in the M & G Group, the world’s largest manufacturers of PET resins for packaging, has initiated patent infringement proceedings against Red Bull Deutschland and Alpa Werke Alwin Lehner.

The case concerns a gas barrier barrier patent for PET copolymers with passive barrier for the packaging of soft drinks. M & G normally offer licences on their patents to those wishing to utilise them. Despite an appeal from Alpa that the claim be dismissed, the judge has ordered the defendants to submit responses by the 2nd of June, 2009. The oral hearing has been scheduled for the 28th of January, 2010.
